1What is in the pass
- Timed exams, as many as you want. Each one is 120 questions in 4 hours, with each portion drawn across its content areas in the item counts the Texas handbook gives, so a full timed exam is 80 national and 40 state questions, with questions you have not seen yet served first. You get your score against the 70% pass line and a score for each portion, since each portion is passed separately.
- Practice by topic. Pick any of the 8 national content areas or a Texas area, or the questions you missed last time. The right answer and the reason appear as soon as you answer.
- Texas questions with their law cited. 135 questions on Texas rules: the Commission and the recovery trust account, licensing and continuing education, trust money and advertising, intermediary practice and brokerage disclosures, promulgated contract forms, community property, homestead, the DTPA and landlord-tenant rules, and more. Each explanation names the Texas Occupations Code section, TREC rule or other Texas statute it comes from, with the date it was read.
- National questions to the outline. 400 questions on the principles every state tests, weighted to Pearson VUE's national content outline, down to each sub-topic. They include the 80 on the free practice exam.
- Your weak topics, tracked. Every answer is recorded in your browser, so the app can show your accuracy by topic and send you back to the areas below the pass line.

2How the Texas sales agent exam works
- Two portions. The sales agent exam has a national portion of 85 items (80 scored, the rest unscored pretest items) in 150 minutes, and a state portion of 50 items (40 scored) in 90 minutes. Taken together you have 240 minutes.
- Passing score. You need 56 correct on the national portion and 28 correct on the state portion. Each portion is passed on its own, and if you fail one you retake only that portion within one year of filing your application.
- Attempts. You have three attempts to pass both portions before the application expires; after a third failure more qualifying education is required before you can test again.
- How many pass. In the two years to November 30, 2025, 56.12% of sales agent exams were passed. That is a first-attempt figure from TREC: a student counts as passing only if both portions were passed on the first try.
- Pretest items. Pretest items are mixed in with the scored ones and are not identified, so answer every question.

3A sample Texas question
This is one of the Texas questions in the pass, shown with its explanation and the law it comes from.
When a license holder acts as an intermediary, how do the intermediary duties in the Act relate to duties under other law, such as common law agency duties?
- Common law duties control when the two conflict
- Both sets of duties apply equally, and the stricter one controls
- Intermediary duties apply only if the parties waive common law duties in writing
- The intermediary duties supersede duties established under any other law, including common law
Answer and explanation
Answer D: The intermediary duties supersede duties established under any other law, including common law
The Act provides that the duties of a license holder acting as an intermediary supersede duties established under any other law, including common law. No balancing test applies, and the stricter duty does not control. No written waiver of common law duties is required.
