Pearson VUE's Indiana outlines give the national portion as 80 scored items across eight areas and the Indiana portion as 50 scored items across five areas (5, 9, 12, 17 and 7). The real exam also carries 5 national and 5 to 10 Indiana pretest items that are not scored, so the handbook's question total for the exam is larger than the scored items; the timed exam here draws only the scored items, in those counts, in the handbook's 240-minute seat time. The Indiana questions come from the Indiana Code only: the Commission's rules (876 IAC) are published on a site that serves no content to this site's fetches, so rules-only topics such as advertising, branch offices and unlicensed assistants are not asked.

3A sample Indiana question

This is one of the Indiana questions in the pass, shown with its explanation and the law it comes from.

A buyer's broker receives a share of the commission that the seller pays at closing. The buyer's broker never agreed to represent the seller. Does the seller's payment of compensation create an agency relationship between the buyer's broker and the seller?

  1. Yes, because the party who pays the compensation becomes the licensee's client.
  2. Yes, but only if the payment exceeds half of the total commission.
  3. Only if the payment is made from the seller's proceeds at closing.
  4. No, because the payment of compensation does not create an agency relationship.
Answer and explanation

Answer D: No, because the payment of compensation does not create an agency relationship.

Indiana separates who pays from who is represented. The payment of compensation by itself does not create an agency relationship with a seller, landlord, buyer, or tenant. A weak candidate may assume the payer is the client, but the statute rejects that idea, no matter the amount or source of the payment.
